1. Alison Turner, a 网爆门 individual member agrees to the following outcome of the investigation into a complaint of a failure to meet the Professional Standards under reference PCP[鈥.
Background
2. Alison Turner has been a 网爆门 member since [鈥.
3. The Member works in [鈥.
4. On 8 August Year 1 a referral was made about the Member鈥檚 conduct. In summary, it is alleged that she failed to advise a Supervisee to make an appropriate safeguarding referral in respect of a [鈥 female client who had disclosed to the Supervisee that she had been sexually abused [鈥.
Admissions
5. The Member makes the following admission which the 网爆门 accepts:
Allegation 1
The Member failed to advise her Supervisee to make an appropriate safeguarding referral in respect of a young person who had disclosed that she had been sexually abused.
Mitigation
6. The Member puts forward the following in mitigation, which has been taken into account by the IAC in deciding the appropriate outcome:
The Member now accepts that the advice she gave was incorrect. She has considerable experience working with victims of sexual abuse and should have been more mindful of the risks towards the client. The Member stated the reason for non-disclosure was that the supervisee鈥檚 client was considered vulnerable. The Member has explained that she considered both options and the effects each outcome would have on the client. This resulted in the decision to prioritise the client鈥檚 needs. This was primarily due to the risk and the potential negative psychological impact on the client, if she were to disclose, which would lead to the client terminating the counselling relationship which was a key part of her recovery.
The Member advised that she is in the process of retiring and is not taking on any new clients; with her existing supervisees she is now more mindful of issues surrounding safeguarding and the need to disclose such information.
Conclusion
7. The issues identified and admitted by the Member amount to breaches of the professional standards reasonably expected of the Member having regard to the Ethical Framework, in particular paragraphs 11 (We share a responsibility with all other members of our professions for the safety and wellbeing of all clients and their protection from exploitation or unsafe practice. We will take action to prevent harm caused by practitioners to any client) and 63 (All supervisors will model high levels of good practice for the work they supervise, particularly with regard to expected levels of competence and professionalism, relationship building, the management of personal boundaries, any dual relationships, conflicts of interest and avoiding exploitation.)
8. One of the aims of the Professional Conduct Procedure is to protect members of the public. The IAC in considering the appropriate outcome and sanction for the admitted breaches in this case has taken into account the interests of public protection and determined that it is reasonable and proportionate to conclude it by agreement on the terms set out below.
9. In relation to the finding above the IAC considers it appropriate that the Member should provide to 网爆门, within 8 weeks of the date of this agreement:
a. Evidence of successful completion of at least 6 hours of CPD in relation to the safeguarding of children and young people.
b. A reflection on her learning from the CPD, with reference to this case and to how she has changed her practice as a result.
c. Confirmation that she has discussed the CPD and her reflection with her Supervisor.
10. The Member agrees that this Agreement will be published by the 网爆门 in line with the Publication Policy and that it will be disclosed to the Referrer.
11. The Member agrees that she will not act in any way inconsistent with this agreement such as, for example, by denying the admission in paragraph 5 above.
12. If the Member fails, without good reason, to comply with the sanction set out above or acts in a way which is inconsistent with this Agreement the matter will be referred to a sanction panel for consideration. A sanction panel may determine that it will terminate her membership. Such a decision will be published.
